Enforcing letters rogatory, which are official requests to foreign courts for evidence or testimony, can be tricky. There are several reasons why these requests are not easy to carry out, including differences in laws, language problems, and issues with getting other countries to honor court orders.

Differences in legal systems

One of the biggest challenges is that different countries have different legal rules. Each country has its own way of handling evidence and court orders. This can make it hard to get the cooperation needed from foreign courts because they might not follow the same rules or timeframes as in the requesting country. These differences can cause delays or even lead to the request being turned down.

Language barriers and translation problems

Another challenge is language. When a letter rogatory is sent to another country, it usually needs to be translated into the language of that country. If the translation is not accurate or clear, the foreign court may reject the request. This can slow things down or even cause the request to fail.
